ConstructVerify Terms of Service

Users must provide accurate account information and maintain the security of their login credentials.

Users are responsible for activities performed through their account except where prohibited by applicable law.

ConstructVerify may suspend accounts where fraud, credential misuse, security concerns, policy violations, or unauthorized activity are reasonably suspected.

ConstructVerify facilitates and manages independent technical peer review of construction documents.

Services may include:

• Construction document review
• Discipline review
• Drawing markup and redlines
• Coordination review
• Permit-readiness review
• Revision review
• Review reporting
• Related administrative services

ConstructVerify reviews do not replace the responsibilities of the Architect of Record, Engineer of Record, licensed design professional, contractor, building official, permitting authority, or other legally responsible party.

ConstructVerify does not become the designer of record by performing a review.

Clients and their retained professionals remain responsible for the accuracy, completeness, code compliance, coordination, approvals, construction suitability, and professional sealing of project documents.

A ConstructVerify review is intended to improve document quality and identify issues reasonably observable within the agreed scope.

It does not guarantee:

• Permit approval
• Regulatory approval
• Error-free documents
• Identification of every design defect
• Construction cost or schedule outcomes
• Compliance with every applicable requirement

Permit-readiness scores, indicators, and assessments are informational review tools and are not governmental approvals.

Clients are responsible for providing accurate information regarding project type, area, disciplines, jurisdiction, scope, and submitted documents.

ConstructVerify may correct or request clarification of submitted information during administrative intake review.

Initial prices displayed before administrative confirmation are preliminary estimates.

Final review cost may depend on:

• Building type
• Project area
• Selected disciplines
• Review type
• Project complexity
• Review urgency
• Permit-readiness requirements
• Administrative scope assessment

Once ConstructVerify confirms the project, the confirmed project information and Total Review Cost may become locked.

Payment is generally required according to the invoice and project terms presented through the platform.

ConstructVerify may use third-party payment processors including global card processors, regional payment providers, or approved bank-transfer arrangements.

Payment processing may be subject to separate provider terms.

Invoices may be denominated in United States Dollars (USD) unless otherwise stated.

Where a payment instrument is denominated in another currency, conversion rates and external conversion fees may be determined by the client's financial institution or payment provider.

Additional payment-processing disclosures may appear before checkout and form part of these Terms.

ConstructVerify controls reviewer assignment.

Clients may not circumvent the platform to solicit, hire, compensate, or contract directly with reviewers introduced through ConstructVerify in connection with platform projects.

Reviewer identities may be limited in client-facing materials.

Users must protect confidential information obtained through the Services and may use project information only for authorized project purposes.

Clients retain their rights in project documents they submit.

Clients grant ConstructVerify a limited right to host, process, reproduce, transmit, and make project documents available to authorized reviewers and service providers solely as necessary to provide the Services.

ConstructVerify retains rights in its platform, workflows, branding, templates, software, methodologies, and proprietary materials.

Users may not:

• access another user's account without authorization
• upload malicious software
• circumvent platform security
• misrepresent qualifications
• use ConstructVerify for unlawful activity
• scrape protected platform data
• interfere with platform operation
• attempt unauthorized Client ↔ Reviewer contact

ConstructVerify may modify, maintain, suspend, or discontinue portions of the Services where reasonably necessary.

ConstructVerify does not guarantee uninterrupted or error-free operation.

The platform may rely on payment providers, hosting services, communications providers, analytics providers, and other third parties.

Their services may be governed by separate terms and privacy notices.

To the maximum extent permitted by applicable law, liability associated with the Services will be subject to limitations stated in the applicable project agreement, order, or supplemental terms.

Nothing in these Terms excludes liability that cannot lawfully be excluded.

Where legally enforceable, users are responsible for claims arising from unlawful use of the platform, violation of these Terms, infringement of third-party rights, or unauthorized use of project information.

ConstructVerify may suspend or terminate access for material breach, fraud, security risk, nonpayment, professional misconduct, or persistent policy violations.

ConstructVerify may update these Terms periodically.

Material changes will be communicated where required by applicable law.

The Services are provided across multiple jurisdictions. Unless otherwise stated in a Project Order, invoice, supplemental terms, or applicable regional terms, these Terms are governed by the law applicable to the ConstructVerify contracting entity providing the Services.

Project-specific professional, building-code, permitting, licensing, data-protection, tax, payment, and other mandatory legal requirements remain subject to the laws and regulations applicable to the jurisdiction in which the Project or regulated activity is located.

Nothing in these Terms limits rights or protections that apply under mandatory law and cannot lawfully be excluded or varied by agreement.

Where applicable law does not permit the parties to select or exclude a particular governing law, the governing law will be determined in accordance with the applicable conflict-of-laws rules.
